Network Rail has lost an appeal against a £500,000 fine.
The company, which manages Britain’s railway network, had contested the fine relating to an incident in Suffolk several years ago.
In July of 2010 a boy was seriously injured in an accident on an unmanned level crossing taking a private road near Beccles across the railway.
Network Rail Infrastructure Limited was handed the fine in June last year but decided to challenge it.
However the Lord Chief Justice Lord Thomas, sitting in the Court of Appeal with Mr Justice Mitting and Mrs Justice Thirlwall, said today there was no grounds for criticising the level of the fine.
