Ipswich: Police officer battered by father and son Millwall fans, court hears

Millwall supporters Barry and Daniel Smith rained down blows on a police officer at Ipswich railway station, a court heard.


When asked to described the father and son’s behaviour during their trial before Ipswich magistrates, British Transport Police Constable Gary Hayes said: “Extremely violent. They were extremely drunk – indescribable behaviour”.

Barry Smith, 50, of Southlands Grove, Bromley, and Daniel Smith, 19, of Restons Crescent, London, have denied assaulting Pc Hayes and another officer following Millwall’s game against Ipswich on April 21.

The pair claim they were assaulted by police, the court heard.

Giving evidence Pc Hayes said he had seen a young man outside the Riverside public house opposite the railway station at around 5.35pm. The young man was abusing a group of young Ipswich fans.

Around 10 to 15 minutes earlier he had seen Daniel Smith abuse an old man wearing and Ipswich Town scarf, but did not approach him as something else occurred, the court heard.

Pc Hayes said he then went back to the pub where a group of people were abusing youths. Daniel Smith was not one of the group.

Magistrates were told that while Pc Hayes was speaking to a young man, Daniel Smith came up to him and appeared to be drunk.

Pc Hayes said he recognised him from the earlier incident.

One of the officer’s colleagues stepped in to stop Daniel Smith, who became very aggressive, the court heard.

While he was being restrained, his father - who was also said to be drunk, became involved with Pc Hayes’ colleague who was holding back Daniel Smith.

Fearing for his fellow officer’s safety Pc Hayes said he went towards the Smiths and pushed the older man in the chest, telling him to get back.

At that point Daniel Smith is said to have punched Pc Hayes in the face, cutting his nose. Magistrates were told Barry Smith then punched the officer several times, as did his son. Pc Hayes said: “I came under a hail of punches, but other police units arrived and took the males to the floor.”

As a result of the alleged incident, the court heard Pc Hayes sustained cuts, swelling and grazing. He told the magistrates that although his nose was out of alignment, doctors said it was not broken. The trial will resume on December 14.
