Teles-Junior had pleaded not guilty to driving a car above the legal drink drive limit on October 8.

Magistrates at the Ipswich courthouse dropped his case after hearing the correct procedures weren't followed on the 40-year-old's arrest.

Acting on behalf of the Crown Prosecution Service, Marc Cannatella, told the court: "On the issue in respect of providing specimens a strict code of practice must be adhered to in requiring someone to provide specimens.

"In order to comply with the strict code the person needs to be informed that failure to provide that specimen means they (the defendant) could be liable to prosecution – even when the person goes on to provide the specimen which is above the legal limit."

He referred to a video following Teles Junior's arrest, saying: "It was clear to me that the warning wasn't given in Portuguese or Spanish."

Teles Junior, of Tamerin Gardens, Cherry Hinton, Cambridgeshire, faced three charges which also included driving without an MoT certificate and driving without insurance.

All were dismissed.

Craig Marchant, who represented Teles Junior, declined to comment after the case.
