Mr Payne, 34, of Park Road in Ipswich ran Church's winebar until May last year when he sold the business.
Jeff Hunt, who now runs the café/winebar in Tower Churchyard in the town centre said Mr Payne no longer had anything to do with the business.
"We are trading successful and have nothing to do with Mr Payne or his business problems," he said.
Mr Payne's company Time and Time Ltd was placed in compulsory liquidation two years ago by the High Court following a request by HM Customs and Excise.
It owed them more than £21,000 and had total debts of £193,000.
The disqualification order was obtained by the Insolvency Service, part of the government's department of trade and industry.
It was granted because Mr Payne did not dispute that he had: failed to submit VAT returns on time, failed to pay VAT when due, failed to submit PAYE returns, and failed to account for income tax and national insurance contributions that had been deducted from his employees.
