A Trimley St Martin man who fractured a man’s collar bone in a drunken late-night attack in Ipswich town centre has been given a suspended jail term.

Luke Greenland was outside the Sainsbury’s store in Upper Brook Street, Ipswich, when he was pushed to the ground by Matthew Tortice and then slapped across the face, Ipswich Crown Court heard.

Mr Greenland, who had spent the evening in the town centre drinking with friends, had no recollection of the incident until he woke up in Ipswich Hospital where he was found to have two fractures to his collarbone, said Godfried Duah, prosecuting.

Tortice, 23, of Old Kirton Road, admitted assaulting Mr Greenland causing him actual bodily harm in the early hours of January 11 and was given an eight-month prison sentence suspended for two years.

He was given six months’ supervision by the probation service and ordered to abide by a six-month curfew from 8pm-6am from Friday to Sunday.

He also agreed to receive community-based advice in relation to his alcohol consumption and to pay £500 compensation to Mr Greenland.

Mr Duah said that when Tortice was shown CCTV footage of the incident he was “completely shocked” by his actions.

“He said he didn’t intend to hurt his victim and wanted to apologise,” said Mr Duah.

Craig Marchant, for Tortice, said the victim had made a movement which his client had misinterpreted while he was drunk.

He said Tortice had no similar convictions and had expressed genuine remorse.

He said Tortice was determined to address his alcohol use and not to go out and get drunk in the future.
