An appeal to build 300 homes off Bell Lane in Kesgrave could end up going to the High Court after Persimmon Homes has called for a judicial review of the Planning Inspectorate’s appeal findings.
An appeal was lodged by the developer after plans to build 300 homes on the greenfield land was rejected by Suffolk Coastal District Council’s planning team in June last year.
The appeal was held in August, with the Inspectorate confirming in October that the appeal had been dismissed and no build would go ahead.
Now, a Planning Inspectorate spokesman has confirmed that a legal challenge was lodged by Persimmon on November 24.
It is understood the judicial review is against the Inspectorate’s findings at this stage.
The news means that the matter could go to the High Court, although it is not yet clear if or when this may happen.
