Food safety officers found a "very poor" state of cleanliness in a spot check at The Oriental Fountain, in Station Road West, Stowmarket.
Mid Suffolk Council decided to take legal action after the inspection last August.
Bury St Edmunds Magistrates Court is due to hear the case today. The Oriental Fountain is set to face charges of contravening food safety regulations.
